Licensing Terms


When you purchase products, images or animations from LionSorbet Ltd you are in fact purchasing a license to use that item. Different licenses give you different rights of usage. For most instances our Regular License is most appropriate. Customers of Lionsorbet Ltd can also purchase Extended Licenses granting you additional rights.

OUR SIMPLE LICENSE GUIDE

A simple way to figure out which license you need for your project is to ask yourself: Will my final product be sold to multiple people? If the answer is YES, then you’ll probably need an extended license.

1.0 Regular License

tickThe regular license allows you to use an item within a project of your own or on behalf of a client. For example, you could use an item purchased under a regular license in a website, a presentation, a promotional video, a poster or a free game. For web content a regular license is suitable for use on a single domain or single subdomain or single directory. For most buyers the regular license is sufficient.

crossThe main thing you cannot do is offer the item up for resale either on its own or as part of a project. So you can use the item in a website, but not in a website that is on sale, leased or provided in a web template in any form.



2.0 Extended License

tickThis license is more expensive than the regular license. An extended license lets you use an item in something that will be sold. For example, you could use an item purchased under an extended license in a DVD release for sale, in a game for sale, in a web template for sale, or on a t-shirt or poster for sale. An extended license is also appropriate for people looking to offer a web template to many users such as on multiple domains, sub-domains or sub directories.

crossAn extended license does NOT allow you to resell the item by itself. You may only incorporate the item into a larger work that is then sold. The original item will always remain the property of the author.

FULL LEGAL TERMS

1.0 Regular License

The Regular License grants you, the Purchaser a non-exclusive, non-transferable right to make use of the files that you acquire in any format supplied. (FILES). Your use of the files, under the Regular License, is subject to the following conditions:

(a) Your use of the files are limited to a single application.

(b) You may use the files alone or you may incorporate the files into another work you are creating.

(c) Unless you have our prior written consent, you must not directly or indirectly license, sub-license, sell or resell or provide for free the files or offer to do any of these things. All of these things are referred to as Resale.

(d) You may reproduce the files for your own business use; in a printed format or;

  1. on a website or;
  2. in an electronic document such as a PowerPoint presentation or an eBook or;
  3. as part of software you create or;
  4. in a video production or;
  5. in a music track.

(f) You may use the files in a work which you are creating for your own purposes or for your client who has asked you to create it.

(g) You must not incorporate the files in a work which is created for Resale by you or your client.

(h) If the files are used or incorporated in a work there is no restriction on the number of copies of that work that can be reproduced and distributed (provided the use/incorporation remains a single application and the copies are not for Resale).

For example, you may incorporate the files, such as a graphic, in a brochure you design for your client. An unlimited number of copies of the brochure incorporating the files may be made but the files cannot be incorporated in any other application. The brochures must be distributed to recipients at no charge to the recipient.

(i) Notwithstanding the restriction on Resale, if you acquire the files on behalf of your client you may recoup from your client the cost of acquiring the files.

(j) If the whole, or part, of the files has been created using materials which are the subject of a GNU General Public License (GPL), your use of the Work (or part Work) is subject to the specific terms of the GPL in place of the foregoing conditions (to the extent the GPL applies).

(Previously referred to as: Single Use, Limited Licence and Single Use No Resale Licence ["Single Use"])

2.0 Extended License

The Extended License grants you, the Purchaser a non-exclusive, non-transferable right to make use of the files that you acquire in any format supplied. (FILES).

Your use of the files, under the Extended License, is subject to the following conditions:

(a) Your use of the Files is limited to a single application.

(b) You may use the Files alone or you may incorporate the Files into another work you are creating.

(c) Unless you have our prior written consent, you must not directly or indirectly license, sub-license, sell or resell or provide for free the Files or offer to do any of these things unless the Files is incorporated into a work you have created. All of these things are referred to as Resale.

(d) You may reproduce the files for your own business use;

  1. in a printed format or;
  2. on a website or;
  3. in an electronic document such as a PowerPoint presentation or an ebook or;
  4. as part of software you create or;
  5. in a video production or;
  6. in a music track.

(e) You may use the files in a work which you are creating for your own purposes or for your client who has asked you to create it.

(f) You may incorporate the Files in a work which is created for Resale by you or your client (provided that only the complete work is offered for sale and the terms of sale (i) require those that acquire the work to only use the Work for their own personal use or in a work they are creating for a client (ii) prohibit resale of the Files as a stand-alone item).

(g) You may display the Files, and make the Work available for use by an unlimited number of your clients, in conjunction with a web site service that you host on behalf of your clients. When using the Files through a web site service, you may make unlimited copies of the Files but you must procure that your clients do not reproduce or use the Files in another application.

(h) If the Files are used or incorporated in a work there is no restriction on the number of copies of that Files that can be reproduced and distributed.

For example: you may incorporate the Files, such as a website template that you or your client distributes commercially. An unlimited number of copies of the software program may be made and sold but the Files cannot be incorporated in more than one software program or other work. Additionally, buyers of the software program must not offer the Files for sale, such as on an e-commerce platform.

(i) Notwithstanding the restriction on Resale, if you acquire the Files on behalf of your client you may recoup from your client the cost of acquiring the Files.

(j) If the whole, or part, of the Files has been created using materials which are the subject of a GNU General Public License (GPL), your use of the Files (or part Files) is subject to the specific terms of the GPL in place of the foregoing conditions (to the extent the GPL applies).

(Previously referred to as: Single Use Conditional Resale Permitted Licence ["Conditional Resale"] and Web Service Licence ["Web Services"])

3.0 Returns and Refund

Lionsorbet Ltd DO NO accept returns or provide refunds for any digital content provided for download via email or digital transfer. The only exception to this rule is if the files:

1: Do not work at all

2: The files are corrupt

The following additional terms apply to our distribution of Products on our website and listed services. No refund is provided or allowed on Products that can be previewed by the Buyer (such as image packs, graphics, videos and animation files). Where Products cannot be previewed by the Buyer (such as products that have not been created yet or LionSorbet Ltd do not hold as stock items) and the Buyer asserts that the Product is not as described or is broken or is corrupt, LionSorbet Ltd promise to give the Buyer a full refund on the Product price if the Buyer requests the refund within 30 calendar days after purchase and the claim is found to be valid.

4.0 Acceptance

By purchasing, displaying and using content from LionSorbet Ltd you have agreed to the the above legal terms under the license of which is appropriate to you.

All Extended licence agreements are discussed and agreed in writing before files can be used for re-sale in any form. If you do not have a signed agreement on behalf of LionSorbet then you automatically fall under our regular license agreement.

All Digital files received and paid for are non returnable and non refundable.
